1. About us
These terms govern the sale of Beijo de Deus chocolate via this website. The seller is [your legal name / business name], registered in Portugal at [your address], with tax number (NIF) [your NIF]. Contact: hello@beijodedeus.com.
2. The product
Beijo de Deus is artisan chocolate made by hand in Portugal. The current edition contains:
- Cacao paste: 100%, single origin.
- Smoked malagueta: 5g per bar.
- No sugar. No milk.
- Possible traces of nuts (made in a kitchen that handles nuts).
Because each bar is made by hand in small numbered editions, slight variations in appearance, weight, and intensity are normal and intended.
3. Placing an order
To order, click Receive yours on the home page. You will be taken to a secure Stripe checkout page where you enter your shipping address and payment details. A confirmation email is sent automatically once payment is complete.
Your order is only confirmed once we send you a written confirmation by email. We reserve the right to refuse any order at our discretion (for example, if the edition is sold out or if there is a pricing error).
4. Prices and payment
All prices are shown in euros (€) and include Portuguese VAT (IVA). Payment is processed by Stripe, our payment service provider. We never see or store your full card details.
Shipping costs are calculated separately at checkout and depend on the destination.
5. Shipping
- Where we ship: Portugal and EU Member States.
- Delivery time: 3–5 business days from dispatch, weather permitting.
- Packaging: all orders ship registered, insured, and with isothermal packaging to protect the chocolate.
- Risk: risk of loss or damage passes to you upon delivery. If the package arrives damaged or the chocolate has melted, contact us within 48 hours and we will replace or refund.
6. Right of withdrawal
Under EU Directive 2011/83/EU on consumer rights, you generally have 14 days to withdraw from a distance purchase without reason.
However, this right does not apply to:
- Goods that are liable to deteriorate or expire rapidly (Article 16(d)).
- Sealed goods which are not suitable for return due to health or hygiene reasons and were unsealed after delivery (Article 16(e)).
Because Beijo de Deus is a perishable food product, the 14-day right of withdrawal does not apply once the order has been shipped. By placing an order, you acknowledge and accept this.
This does not affect your statutory rights if the product is faulty, damaged, or not as described.
7. Faults, damage, and refunds
If your chocolate arrives damaged, melted beyond use, or otherwise faulty, contact us within 48 hours of delivery at hello@beijodedeus.com with a photo and your order number. We will, at our discretion:
- Send a replacement bar, or
- Issue a full refund of the purchase price and shipping.
This is in addition to your statutory rights under Portuguese consumer law (Decree-Law 84/2021).
8. Allergens and consumption
Beijo de Deus is made in a kitchen that handles nuts; trace contamination is possible.
The product contains a significant amount of capsaicin (chili) and is intended for adults. It is not suitable for children, pregnant women, or people with sensitivities to spicy food or capsaicin. By purchasing, you confirm that you have read the ingredient list and understand the nature of the product.
Consume responsibly. Store cool (below 20°C) and dry, away from direct sunlight.
9. Intellectual property
All content on this website — text, images, branding, logos — is the property of Beijo de Deus and protected by copyright and trademark law. You may not reproduce or use any content for commercial purposes without our written permission.
10. Liability
To the maximum extent permitted by law, our total liability for any single order is limited to the price paid for that order, plus shipping. Nothing in these terms excludes liability for fraud, gross negligence, or death or personal injury caused by our negligence — none of which can be excluded under law.
11. Force majeure
We are not liable for delays or failures caused by events outside our reasonable control, including extreme weather, postal strikes, pandemics, or acts of public authority.
12. Governing law and disputes
These terms are governed by the laws of Portugal. Any dispute will first be approached in good faith between us. If no resolution is reached, you may submit the dispute to:
- The Portuguese Centre for Consumer Arbitration in your region (Centro de Arbitragem de Conflitos de Consumo).
- The EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
- The competent Portuguese courts.
13. Changes to these terms
We may update these terms from time to time. The version that applies to your order is the one in effect when you placed it.
